Welcome to The Wresh Workshop, LLC. By enrolling in our lessons, classes, or workshops, you (the "Student" or "Guardian") agree to be bound by the following terms and conditions:
1. Professional Standards & Environment
- We are committed to providing music and voice instruction in a professional, competent, and timely manner.
- All instructors meet applicable background screening requirements in accordance with Miami-Dade County policies.
- We maintain a respectful, supportive, and safe learning environment for all students.
2. Student & Parent Responsibilities
- Conduct: Students must behave respectfully toward instructors, staff, and other students at all times.
- Care of property and instruments: Students are expected to treat the School's and the host facility's instruments, equipment, furnishings, and premises with care. The Student/Guardian is responsible for the cost to repair or replace any property of the School, its instructors, or the host facility that is damaged or lost through the Student's (or an accompanying Guardian's) misuse, negligence, or intentional act, beyond ordinary wear from normal use.
- Preparation: Students should arrive punctually and prepared with assigned materials.
- Practice: While results are not guaranteed, we recommend a minimum practice schedule of three (3) times per week for at least fifteen (15) minutes.
- Supervision: Guardians are responsible for timely drop-off and pick-up. The School is not responsible for supervision outside of scheduled class times.
- Health & Wellness: Out of respect for fellow students, instructors, and the families we serve, Guardians are asked to keep students home when they are showing signs of contagious illness (including but not limited to fever, persistent cough, or runny nose) within the previous 24 hours. The School's emergency-cancellation allowance under Section 3 exists in part to support families in honoring this expectation without financial penalty.
3. Payments & Cancellations
- No refunds. Class and lesson fees are non-refundable. The standard remedies for missed lessons are make-ups within the cancellation window described below, and up to two (2) emergency cancellations per semester. In rare cases of extreme circumstance, a partial refund may be considered at the School's sole discretion.
- Payment: Fees are due no later than the completion of each lesson. We reserve the right to adjust rates with 30 days' written notice.
- Cancellation: To be eligible for a make-up, you must provide at least 24 hours' written notice.
- Late Cancellations: Cancellations made with less than 24 hours' notice will be charged in full and are not eligible for a refund or make-up.
- Emergency Cancellations: At our sole discretion, we allow up to two (2) emergency cancellations per semester (e.g., illness, unforeseen circumstances) to be rescheduled.
- Termination: Either party may terminate lessons at any time with 24 hours' written notice.
- Conduct-based dismissal: The School may remove a student from a class or lesson, or dismiss a student from the program entirely, at the School's sole discretion, when the behavior of the student or an accompanying guardian is disruptive, unsafe, disrespectful, or otherwise incompatible with a positive and safe learning environment, or when a guardian repeatedly fails to comply with School policies. Where practical, the School may first raise the concern with the guardian, but for serious conduct, including any behavior that threatens the safety or well-being of others, dismissal may be immediate and without prior notice. Fees already paid remain non-refundable as described in this Section 3.
4. Liability & Safety
- Assumption of Risk: Participation in our classes, lessons, rehearsals, and performances may involve physical movement (including stretching, stage movement and physical staging, and the use of instruments), which carries an inherent risk of minor injury. Students and Guardians voluntarily assume these risks, including risks that may arise during rehearsals, recitals, showcases, and other performances.
- Communicable illness: Group instruction involves contact with other students, families, and staff. The Student/Guardian understands and voluntarily assumes the inherent risk of exposure to colds, viruses, and other communicable illnesses, and agrees to hold The Wresh Workshop, LLC harmless for any illness arising from participation, except in cases of gross negligence.
- Professional instruction; no guaranteed outcome: The School provides instruction using reasonable professional skill and care. Artistic progress depends on many factors, including the student's own practice, effort, and aptitude. The School does not guarantee any specific result, level of improvement, casting, audition outcome, admission, award, or career outcome.
- Waiver: To the fullest extent permitted by Florida law, Students/Guardians assume all risks and agree to hold The Wresh Workshop, LLC harmless from liability for injuries or damages, except in cases of gross negligence.
- Medical Consent: In the event of a medical emergency where a Guardian cannot be reached, the School is authorized to obtain necessary emergency medical care at the Guardian's expense.
5. Child Safeguarding
- Zero tolerance. The Wresh Workshop has zero tolerance for sexual abuse, sexual misconduct, or the sexual exploitation of any child in our care, by any owner, instructor, contractor, or volunteer, in any setting.
- Background-checked instructors. Every instructor and adult volunteer with student contact is screened through the Florida Department of Law Enforcement VECHS Level 2 fingerprint background check, including the National Sex Offender Registry, before any student contact begins, and is trained on child safeguarding before starting and annually thereafter.
- Observable instruction. All classes and lessons take place in rooms that are visible from a public area, with the door never locked. Guardians have the standing right to enter and observe any class or lesson at any time, without notice.
- Guardian presence. The attending parent or guardian remains in the room for Mommy & Me (ages 1–3). For all other classes and private lessons, whether a guardian remains on premises during the session is the guardian's choice.
- Off-premises boundaries. Babysitting, transportation outside of school activities, home visits, and one-on-one off-site outings between an instructor and a student are not permitted.
- Mandatory reporting. The Wresh Workshop is a mandatory reporter under Florida Statute § 39.201. Any allegation, disclosure, or credible suspicion of abuse is reported to the Florida Department of Children and Families (1-800-962-2873) and to local law enforcement, without delay, and the involved adult is immediately suspended from all student contact pending investigation.
- How to raise a concern. Concerns may be raised with Rachel directly, or reported independently to the Florida DCF abuse hotline at 1-800-962-2873. Call 911 if there is immediate danger.
- Our full Child Safeguarding Policy — including the bathroom-escort protocol, appropriate-contact guidelines, and the full allegation-handling procedure — is published on our website.
6. Class Recording for Safety
- Recording is constant. For the safety of every student and the integrity of every lesson, The Wresh Workshop records all classes and private lessons on video and audio using a school device. Recording occurs only in instructional spaces during scheduled classes, lessons, rehearsals, and performances. Recording never occurs in bathrooms, changing areas, or any space where students reasonably expect privacy.
- Primary purpose is safety. Recordings are kept for safety, accountability, dispute resolution, and as evidence in the event of any allegation or claim.
- Promotional use is separate. Because we capture classes on a single school device, the same footage that documents a lesson may also be the source from which photos or video clips are drawn for promotional or marketing use. All such promotional use is governed by the Media Release in Section 7 below. If a Guardian opts out of the Media Release, no footage of the student from these safety recordings will be used for any promotional or marketing purpose.
- Retention. Recordings are retained for a minimum of seven (7) years from the date of recording, or longer if required by an active claim, investigation, or legal hold.
- Storage and access. Recordings are stored securely. Access is limited to the owner of The Wresh Workshop and, only when legally required or reasonably necessary, to law enforcement, insurance counsel, or legal counsel responding to a specific allegation or claim. Recordings are not shared with other families, students, or third parties except as set out above.
- Florida law (two-party consent). Under Florida law (Fla. Stat. § 934.03), audio recording requires the consent of all parties. By signing this Agreement, the Guardian consents on behalf of the student to the video and audio recording described above.
- Consent is non-negotiable. Withdrawal of safety-recording consent ends the student's enrollment, because this recording is a core safety measure of The Wresh Workshop's program. Withdrawal of Media Release consent, by contrast, does not end enrollment (see Section 7).
7. Media Release
- Includes safety-recording footage. The promotional use covered by this Media Release includes any photos, video clips, or other content drawn from the safety recordings described in Section 6, as well as any photos or video taken at performances or special events. A Guardian's choice to opt in or out of this Release applies to all such content.
- We reserve the right to photograph or record students and present adults during classes or events for promotional purposes (website, social media, marketing).
- No identifying personal information (like full names) will be published without additional consent.
- You may opt out of this media release in writing at any time.
8. Inclusion & Accessibility
- We are committed to an inclusive environment and welcome students of all abilities.
- Families are encouraged to communicate specific needs or accommodations in advance so we can make reasonable efforts to provide an appropriate experience.

9. Ready to enroll?
This agreement is signed electronically as part of registering a student for class. Each student requires a separate signature on file before they can register. Your typed legal name, the date, your IP address, and the version of these terms will be recorded as proof of consent — legally binding under the federal Electronic Signatures in Global and National Commerce Act (E-Sign Act) and Florida law.
